Supreme Court provides significant relief to Tripura villagers
AGARTALA: In a recent ruling, the Supreme Court of India provided significant relief to five villagers from Tepania and Barabhaiya in Gomati District, Tripura, concerning the encroachment of a public road by the district hospital administration. The apex court issued a notice to state authorities and suspended a detrimental April 2026 decision made by the Tripura High Court that had imposed a monetary penalty on the villagers.
Justice Vikram Nath and Justice Sandeep Mehta presided over the case, which was presented by Advocate Nilotpal Datta. The villagers had earlier approached the Tripura High Court regarding what they claimed to be an illegal obstruction of a public road vital for connecting their villages to the Karimganj-Agartala-Sabroom Road.
Originally, the State authorities acknowledged the villagers' claims, categorising the obstruction as illegal and pledging to remedy the situation. However, later proceedings in the High Court revealed a complex turn of events, including a purported secret agreement involving the Rogi Kalyan Samiti and the local Panchayat that suggested a different narrative to the court.
In its decision, the Tripura High Court concluded that the villagers had withheld important facts during their plea, accused them of contempt of court and ordered that previously demolished structures on the road be re-erected at the petitioners' expense. Each villager was additionally required to pay Rs 15,000 as exemplary damages to the Tripura High Court Legal Services Committee.
Following this adverse ruling, the villagers contested their case in the Supreme Court, which has temporarily halted all consequences stemming from the High Court's orders while it reviews the appeal. The case is formally identified as Ajay Debnath & Ors v State of Tripura & Others with the Supreme Court's order dated August 17 2026, and the next hearing scheduled for September 18 2026.
The Supreme Court's intervention marks a critical juncture for the villagers, who now await a comprehensive reassessment of their claims against the state authorities.
